Donald Trump’s legal team has formally petitioned the US Supreme Court to overturn the Colorado Supreme Court’s recent decision, disqualifying the former president from the state’s 2024 presidential ballots due to his alleged role in the Capitol attack. Trump’s attorneys argue that the Colorado court overstepped its authority, contending that the 14th Amendment’s Section 3, which disqualifies those who engage in insurrection, is a matter for Congress, not state courts.

The case, now potentially pivotal for the upcoming 2024 election, has broader implications. Trump’s legal team contends that the presidency falls outside the scope of Section 3 and challenges the characterization of the Capitol attack as an insurrection. The US Supreme Court, yet to opine on Section 3, faces a politically charged decision.

While the Colorado ruling is temporarily halted until January 4, Trump remains on the ballot pending appeal. Colorado Secretary of State Jena Griswold supports the state’s Supreme Court decision, urging a swift response from the US Supreme Court ahead of the presidential primary election.

This legal battle is one of two major constitutional questions involving Trump before the high court, including whether he has presidential immunity from charges related to overturning the 2020 election. With similar challenges emerging in Maine and Colorado, the outcome could have far-reaching consequences, shaping the eligibility criteria for candidates and influencing voters in the upcoming elections.
