The Biden administration unveiled final regulations on Wednesday aimed at enhancing consumer protections in the airline industry, mandating automatic cash refunds for flight cancellations and significant delays, along with improved fee transparency.

The Department of Transportation announced that airlines will be obligated to issue automatic cash refunds within a few days for flights that are canceled or subject to “significant” delays. This move aims to streamline the refund process and provide passengers with timely compensation for disruptions to their travel plans.

Previously, airlines had discretion in determining the threshold for delays warranting refunds. However, the new regulations define a significant delay as lasting at least three hours for domestic flights and six hours for international flights, eliminating ambiguity and ensuring consistency in refund policies.

While airlines will still have the option to offer alternative flights or travel credits, passengers will now have the right to decline such offers and opt for a cash refund instead, empowering consumers with greater choice and flexibility.

Additionally, the rules extend to refunds for checked-bag fees if luggage is not delivered within specified timeframes: 12 hours for domestic flights and 15 to 30 hours for international flights. Moreover, fees for services such as seat selection or internet connectivity will also be subject to refunds if the airline fails to deliver the promised service.

These measures represent a significant step towards bolstering consumer rights and enhancing transparency within the airline industry.
