Seann William Scott’s ex-wife, Olivia Korenberg, lost her plea for their daughter to live primarily with her, Us Weekly can exclusively report.
A Los Angeles Superior Court judge issued a ruling in Scott and Korenberg’s custody battle on Monday, July 28, weeks after the exes testified in court.
Korenberg, 35, accused Scott, 48, of attempting to evict her from one of his homes. He claimed she was only supposed to live in the home for one year. She asked the court to modify their joint custody agreement to have their daughter live with her primarily, which Scott opposed.
The judge noted that he found Scott and Korenberg to be “high-quality” parents who were “completely” devoted to their daughter.

“Korenger’s polarized, zero-sum thinking and inability to acknowledge any of [Scott’s] independent parenting contributions adversely impacted her credibility,” the order noted.
During testimony, Korenberg said she recently signed a lease. The court found she had not given sufficient consideration to Scott when making the decision.

In addition, the judge was unpersuaded by Korenberg’s claims she was unable to locate a “workable housing option whatsoever for herself and” their daughter. The court noted that “per the stipulated judgment, [Korenberg] was to receive $1,000,000 tax free payable upon execution, and she appears to have signed the [lease] before resolution of the pending child support issues.”
The judge denied Korenberg’s request that their daughter live with her primarily and that Scott’s parenting time be substantially reduced. Scott was awarded sole legal custody for the purpose of enrolling their kid in kindergarten.
On top of that, the judge scolded both parties and ordered them to attend coparenting classes. “[Korenberg’s] decision to sign a lease mere days before this hearing which constrains her own short-term flexibility about where she lives is consistent with an effort to exert negotiation power by someone whose self-determination feels threatened,” the judge said.
The judge said Scott had the legal right to ask Korenberg to vacate his home. The court did note that Scott’s notice to Korenberg about the home “lacked explanation, lacked full acknowledgment of how she might experience this news and did not identify mitigating steps he might be willing to take.”

The order noted again that Scott had the legal right to sell his home. “Just because a course of action is legal, however, does not mean that taking it will not have significant relationship consequences or that it would not be wise to be mindful about communicating and explaining it,” the judge said.
“Similarly, [Korenberg] raised repeatedly that she learned about the [divorce] not directly from [Scott] but via social media reports on Valentine’s Day,” the judge added. “”While there may be some explanation for this which was not part of the evidence, it does on its face suggest at best a lack of consideration and at worst a deliberate attempt to publicly humiliate [Korenberg].”

The judge said he made no findings about it but “raises the issue merely to point out that there appears to be ample room here to improve communication.”
“[Korener’s] negative reaction to receiving unexpected, life-altering, upsetting information via an email in December 2024 was understandable and predictable, especially if she perceived Father’s behavior as part of a pattern,” the judge said. The court said coparenting classes would hopefully help their relationship.
As Us previously reported, Scott filed for divorce from Korenberg in 2024 after four years of marriage.

A couple of months later, the exes reached a settlement where they agreed to share joint legal and physical custody of their 5-year-old daughter.
However, Korenberg rushed to court in April, accusing Scott of attempting to “evict” her and their daughter from one of his homes.
She said Scott purchased the $3.5 million home in Malibu in 2024. Korenberg said their agreement said she could live in the home for one year.
In court documents, Korenberg said Scott allowed her to make renovations to the home. She said despite the one-year deal on paper, Scott made it appear she would be living in the home long-term.
Korenberg said everything changed after she asked Scott to meet her new boyfriend. Scott declined the proposal.

Weeks later, Korenberg said she was blindsided when she received a letter from Scott telling her she needed to vacate his home by June. She claimed she was struggling to find a suitable home that was within 20 miles of Scott’s Malibu mansion, which was a requirement in their custody deal.
The American Pie star denied his ex’s claims he blindsided her with an eviction. He said it was never the plan to allow Korenberg to live in his home forever. Scott said he made the decision to sell the home after speaking to his financial advisor.
In a declaration, Scott made it clear his decision was not retaliation after finding out about Korenberg’s new romantic partner. He also told the court that he made costly improvements to the home while Korenberg made “cosmetic improvements.”
He opposed Korenberg’s request to move more than 20 miles away from him and for additional custody.
The custody battle is now officially over.
